When you apply for asylum in the United States\u2014especially in Immigration Court\u2014one of the most common and important questions we hear is:<\/p>

\u201cCan I be detained while my asylum application is pending?\u201d<\/p>

The short answer is: Yes, it\u2019s possible.<\/strong> However, whether ICE chooses to detain you depends on your personal history, criminal background, and immigration status.<\/p><\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t\t\t

\n\t\t\t\t\t\t\t\t\t\t\t\t\t\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<\/path><\/svg><\/span>\n\t\t\t\t\t\t\t\t<\/path><\/svg><\/span>\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t<\/span>\n\t\t\t\t\t\t\t\t\t\t\t\tWhat Is Immigration Detention?<\/a>\n\t\t\t\t\t<\/div>\n\t\t\t\t\t

Immigration detention is a civil\u2014not criminal\u2014form of confinement. It is managed by U.S. Immigration and Customs Enforcement (ICE).<\/strong> ICE may detain individuals who:<\/p>

    • Entered the U.S. without permission;<\/li>
    • Were previously ordered deported;<\/li>
    • Have criminal convictions; or<\/li>
    • Are considered a flight risk or danger to the community;<\/li><\/ul><\/li><\/ul>

      Even if your asylum case is active, you can still be detained if ICE believes you meet one of these criteria.<\/p><\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t\t\t

      You could be detained if:<\/p>

      • You are arrested for a crime while your case is pending;<\/li>
      • You missed a court hearing and were ordered removed in absentia;<\/li>
      • You entered unlawfully and were later apprehended by ICE or CBP;<\/li>
      • You have a prior deportation or removal order;<\/li>
      • You were released under supervision and violated ICE check-in requirements; or<\/li>
      • You were released on bond or an order of supervision, but ICE now believes that circumstances have changed and detention is necessary.<\/li><\/ul><\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t\t\t

        Not entirely. <\/b>While a pending asylum application shows that you are lawfully pursuing protection, it does not <\/b>guarantee immunity from detention. However, the fact that your case is pending can help your attorney:<\/p>

        • Request release on bond; or<\/li>
        • Argue that ICE should exercise discretion and not detain you.<\/li><\/ul><\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t\t\t

          If ICE detains you:<\/p>

          • You may be transferred to a detention facility anywhere in the country;<\/li>
          • You may qualify for a bond hearing <\/b>to request release;<\/li>
          • Your asylum case will likely continue, but possibly under expedited removal proceedings<\/b>;<\/li>
